Lahore High Court passes a legal but an explosive judgment: Kalabagh Dam

Lahore High Court has ordered government to start work on Kalabagh. The court says that Federal government is bound to take implement the decision under under Article 154 of the Constitution. The honorable court said that it issued order because of energy shortage in the country and and flood.  It said they were forced to take this decision because it violates people’s fundamental rights.
The court might have made the decision in good faith, but the there is no consensus on federating units on this issue. We cannot ignore their reservations of small provinces.  Sindh, Balochistan and Khyber Pakhtunkhwa assemblies have refused to support the projects. Some of their objections and concerns are real. This can be resolved through discussions.  For example, the construction of dame will effect five districts of Khyber Pakhtunkhwa. It means it will displaced thousands of people. The question is: Will the government pay them compensation honestly? In Tarbella’s case, people are still protesting for compensation. Can any party make a political toxic decision?
